To further encourage the investors to invest in Tanggu District, to create an investment environment with ¡°Normative conduct, simplified formalities, low charges and loose environment¡±, with the consideration of the district¡¯s specific condition, ¡°The interim measures of zero administrative charges and zero penalties to investment projects in Tanggu District¡± was composed
1. Application scope and conditions
The implementation of ¡°The interim measures of zero administrative charges and zero penalties¡± (hereinafter ¡°Double zeros measures¡±), mainly relate to the enterprises, which registered in Tanggu District and contributed to the district level financial income. It mainly applies to the following items: examination and approval processes like registration with the Administration of Industry and Commerce and the Taxation Administration, etc. during enterprise registration; Examination and approval processes like planning, construction, people¡¯s air defense, municipal construction engineering, city appearance and landscape and forestry, etc. during fix assets investment.
The application conditions are as follows:
1.1 The enterprises following registration formalities with the Administration for Industry and Commerce: the productive enterprises with registered capital over RMB 10 million; enterprises which have been listed into ¡°Tianjin Municipality priority high and new technology industrialization field guidance¡± and private science and technology enterprises; enterprises which have been listed into ¡°The catalogue of national industrial policy encouraged category of industries, products and technologies¡± and with registered capital over RMB 5 million. (The registered capital of enterprises with foreign investment will be calculated according to respective exchange rate of specific foreign currencies to RMB. The same hereinafter).
1.2 The projects with construction items: The productive project with total investment value over RMB 15 million; projects which have been listed into ¡°Tianjin Municipality priority high and new technology industrialization field guidance¡± and private science and technology projects; projects which have been listed into ¡°The catalogue of national industrial policy encouraged category of industries, products and technologies¡± and with total investment over RMB 5 million.
1.3 This interim measures can be applied to priority investment projects which have not been listed into 1.1 and 1.2 and have been reported by respective examination and approval agencies to district chiefs in charge and approved.
2. Administrative items to which ¡°Zero administrative charges¡± is applicable
2.1 The enterprises following company registration formalities can be exempted from the following charges:
2.1.1 The Technology Supervision Administration: universal code certificate fee, organization and institute code card fee, code certificate emergency fee.
2.1.2 The Administration for Industry and Commerce: enterprise registration fee, alteration registration fee of the enterprises which moved into Tanggu District or increased investment.
2.1.3 The State Taxation Administration: taxation registration cost.
2.1.4 The Local Taxation Administration: taxation registration cost.
2.2 The projects with construction items can be exempted from the following charges:
2.2.1 The following charges can be exempted:
2.2.1.1 Construction Administrative Commission: new types of wall development fund, bulk cement fund, construction engineering contract review fee, civilized construction measures fee, place name fee.
2.2.1.2 Town Planning Administration: land registration fee
2.2.1.3 The People¡¯s Air Defense Office: productive projects can be exempted from the people¡¯s air defense construction fee.
2.2.2 The following charges can be halved according to the lowest level:
2.2.2.1 The Construction Administrative Commission: construction engineering transaction services fee, construction equipments transaction services fee, construction inspection transaction services fee, engineering transaction services fee.
2.2.2.2 The Town Planning Administration: Town planning preliminary archive filling fee, relief map surveying fee, cadastral surveying fee.
2.2.2.3 The Municipal Construction and Engineering Administration: road excavation restoring fee.
2.2.2.4 The Landscape and Forestry Administration: compensation fee for plants, green belts and facilities, compensation fee for planting, removing and cutting of plants.
2.2.2.5 The City Appearance Administration: compensation fee for public toilets removing.
3. The principal for implementation of ¡°Zero punishment¡±
The administrative enforcement and supervision agencies should strengthen their work, stop conducts like "arbitrary charges, fund-raising quotas and fines" , and create a loose environment for the district¡¯s investment attraction and the enterprises¡¯ operation.
The general enforcement supervision should be conducted in a ¡°three steps¡± way. That is, the unintentional general violator should be educated, be specified time to straighten things up, and be punished according to the law if they failed to do that. If the enterprise was punished by the administrative agencies due to unintentional factors like unfamiliar with the regulations and formalities, and inadequate construction preparation and uncompleted documents submission, etc., the examination and approval administration agencies should be wholly or partially reimbursed by the ¡°Double zero¡± examination and approval administration agencies after examination, approval and confirmation.
This interim measures do not apply to those punishment due to the following reasons: the enterprise or project unit didn¡¯t perform their commitment; serious safety hazards, environment pollution or social harms caused by intentional conducts, etc.
4. Rules for implementation
4.1 The registered capital of the enterprises following registration with the Administration for Industry and Commerce should be determined as per the business license; the total investment value of the projects with construction items should be determined as per the total investment value listed in the investment plan of the municipal or district planning commission. Those of the private science and technology enterprises should be determined as per those of the district Science and Technology Commission.
4.2 The enterprises or projects to which this interim measures are applicable should be administrated through confirmation respectively. That is, the enterprises registered in Tianjin Marine Hi-Tech Development Area (Hereinafter TMHT) should be confirmed by the Administrative Commission of TMHT; the enterprises registered in Tianjin Lingang Industrial Area (Hereinafter Lingang) should be confirmed by the Administrative Commission of Lingang; the enterprises registered in various communities and counties should be confirmed by particular communities and counties concerned; the rest enterprises registered in Tanggu District should be confirmed by Tanggu Economy and Trade Commission.
The agencies undertaking approval functions should establish specific administrative practices, implement the interim measures strictly according to the application scope and conditions, and are not allowed to extend the scope and decrease the conditions.
4.3 For the enterprises or project to which this interim measures are applicable, the administrative agencies of the place where the enterprises registered in should follow related formalities. The enterprises should pay the related exemptible charges or punishments and get the reimbursement from the ¡°Double zero¡± fund after approved. In terms of charges to be halved according to the lowest level the enterprises should pay 50%. If they paid 100%, 50% can be reimbursed from the ¡°Double zero¡± fund after being confirmed and approved.
4.4 The source of ¡°Double zero¡± fund. The ¡°Double zero¡± fund will be paid by Tanggu Administration of Finance. Related rules should be implemented for units within public financial administration system.
The examination and approval agencies should submit the Tanggu Administration of Finance and the Tanggu Administration of Supervision with the implementation of the interim measures, the list of administrative charges and punishment reimbursement in January of next year. The Tanggu Administration of Finance and the Tanggu Administration of Supervision are in charge of supervision and inspection over the implementation of ¡°Double zero¡± interim measures, and investigate and deal with violations.
4.5 This interim measure shall go into effect as of September 1st, 2005. Tanggu Economy and Trade Commission is in charge of interpretation of this measures. The document of Tanggu Zheng [2003] No.68 shall be abolished.
